1. Introduction and Operator
These Terms of Service ("Terms") govern access to and use of WhispR, a voice-first mobile service offered under the WhispRai™ brand and operated by D. K. Pahwa ("WhispRai", "WhispR", "we", "our", or "us"). WhispR enables adults to create private voice recordings, intentionally publish selected recordings to communities, and interact through voice replies and related community features.
These Terms should be read with the WhispR Privacy Policy and, when published or applicable, the Community Guidelines, Child Safety Standards, and any additional terms presented for a particular feature, Subscription, promotion, or Beta Feature.
2. Definitions
In these Terms:
Account means a registered WhispR user account.
AI Features means optional artificial-intelligence functionality that may include transcription, summaries, emotion analysis, or other disclosed tools.
Beta Feature means any service or feature identified as beta, preview, experimental, early access, pilot, or pre-release.
Community means a topic-based area in which eligible Public Recordings and Voice Replies may be discovered and shared.
Personal Information has the meaning stated in the Privacy Policy and applicable law.
Private Recording means a recording that is private by default and is not intentionally published by its creator.
Public Recording means a recording intentionally published by its creator to a Community or another public area of WhispR.
Services means the WhispR application, website, backend, support, community, notification, and related services covered by these Terms.
Subscription means a paid plan or entitlement offered by WhispR or through an authorised app store.
User Content means recordings, replies, titles, profile material, reports, feedback, and other material a user submits through the Services.
Voice Reply means a recorded response to a Public Recording.
3. Acceptance and Electronic Agreement
By creating an Account, selecting the acceptance controls, or using WhispR, you confirm that you have read and agree to these Terms and acknowledge the Privacy Policy. Any consent required for a particular processing activity will be requested separately or through the relevant feature. If you do not agree to these Terms, do not create an Account or use the Services.
Your electronic acceptance has the same effect as acceptance in writing to the extent permitted by law. We may record the accepted version, timestamp, Account identifier, and age confirmation. Materially revised Terms may require renewed acceptance before continued use.
4. Beta and Pre-release Features
WhispR may make some or all Services available as Beta Features. A Beta Feature may be incomplete, experimental, interrupted, inaccurate, changed, withdrawn, or subject to additional limitations while we evaluate reliability, safety, usability, and product-market fit.
Access to a Beta Feature may be invitation-based, personal, limited, and revocable. It does not guarantee continued access, general release, retention of test data, or preservation of the same functionality. Keep independent copies of information you cannot afford to lose.
This section applies only while the relevant Service or feature is identified as beta or pre-release. Nothing in it excludes rights or duties that cannot legally be excluded.
5. Eligibility
You must:
- be at least 18 years old;
- have legal capacity to enter into these Terms;
- be permitted to use WhispR under applicable law;
- provide accurate and current Account information; and
- use the Services only for lawful purposes.
WhispR records an age confirmation but does not currently require a full date of birth. We may restrict or terminate an Account if we reasonably believe the user is under 18 or otherwise ineligible.
6. Accounts and Security
You are responsible for activity through your Account and for protecting your password, email account, authentication method, device, and recovery links. You must promptly notify support@hellowhispr.com of suspected unauthorised access.
You may not sell, transfer, rent, share, or impersonate another person's Account. We may require re-authentication, email verification, or other reasonable security steps before sensitive Account actions.
7. Licence to Use WhispR
Subject to these Terms, WhispR grants you a limited, personal, revocable, non-exclusive, non-transferable, and non-sublicensable licence to install and use the application for its intended purpose.
You may not copy, modify, distribute, sell, lease, reverse engineer, bypass security controls, scrape, probe, overload, or misuse the Services, except where applicable law expressly permits an activity that cannot be restricted by contract.
8. Private and Public Recordings
Recordings are private by default. A Private Recording is available only through your Account unless you intentionally publish it or instruct WhispR to process it through an optional feature.
When you publish a recording, it may become visible in the selected Community and through Explore, Following, categories, recommendations, search, or similar discovery features. Other users may listen, like, save, report, or submit Voice Replies where permitted.
Before recording or publishing, ensure that you have all rights, notices, permissions, and consents required for every voice, person, work, and item of Personal Information involved. You must not secretly record or publish another person where doing so would violate law, privacy, confidentiality, or their rights.
9. Ownership of User Content
As between you and WhispR, you retain ownership of original User Content you create, subject to third-party rights and applicable law. These Terms do not transfer ownership of your recordings to WhispR.
You represent that you own or have sufficient permission to upload, store, process, publish, and license your User Content as described in these Terms.
10. Licence You Grant to WhispR
You grant WhispR a non-exclusive, worldwide, royalty-free licence to host, store, copy, transmit, encode, adapt for technical formatting, process, back up, and otherwise use User Content only as necessary to operate, secure, and maintain the Services, provide features you request, and comply with law. Product improvement using Private Recordings requires an applicable lawful basis and any consent or disclosure required by law; aggregated or de-identified operational information may be used to improve quality and reliability.
For Private Recordings, this licence is limited to providing features you request, maintaining security, and meeting legal obligations. It does not permit WhispR to make Private Recordings public.
When you publish User Content, the licence also permits WhispR to display, reproduce, distribute, make available, and promote that content within WhispR and in service-related previews or communications. This public-content licence ends when the content is deleted or unpublished, subject to reasonable technical processing, backups, prior user interactions, moderation evidence, and lawful retention.
11. Community Participation
Community participation must be respectful, authentic, and lawful. You are responsible for recordings, replies, profile details, reports, and other interactions submitted through your Account.
WhispR may provide tools to report content, block users, hide posts, save content, and manage Community preferences. Misuse of safety or reporting tools may itself violate these Terms.
12. Prohibited Content and Conduct
You must not upload, publish, transmit, promote, or otherwise use WhispR for the following content or activity.
12.1 Illegal, Exploitative, or Rights-Violating Material
This includes content that belongs to another person without permission; is unlawful, fraudulent, defamatory, obscene, pornographic, sexually exploitative, paedophilic, or harmful to a child; constitutes child sexual abuse and exploitation (CSAE) or child sexual abuse material (CSAM); or infringes copyright, trademark, patent, publicity, moral, or other proprietary rights. 12.2 Abuse, Hatred, and Dangerous Conduct
This includes threats, harassment, bullying, stalking, humiliation, incitement to violence, or promotion of hatred or enmity based on religion, caste, race, ethnicity, gender, sex, sexual orientation, disability, nationality, or another protected status. It also includes encouragement of self-harm, suicide, dangerous behaviour, criminal conduct, money laundering, unlawful gambling, terrorism, or unlawful trafficking. You must not threaten the unity, integrity, defence, security, or sovereignty of India; friendly relations with foreign States; or public order, or incite the commission of a cognisable offence or prevent its investigation.
12.3 Privacy, Identity, and Deception
This includes invading privacy or bodily privacy; exposing confidential information or Personal Information without lawful authority; impersonating another person; misrepresenting identity, affiliation, origin, or authority; or knowingly communicating materially false or misleading information, deceptive manipulated media, or synthetic media without a disclosure required by law or platform rules. You must not remove, conceal, suppress, or alter a label, disclosure, identifier, metadata, or provenance mechanism required for synthetically generated or materially altered information.
12.4 Technical and Platform Abuse
This includes malware, harmful code, credential theft, scraping, automated abuse, spam, unauthorised advertising, platform manipulation, attempts to bypass moderation or security controls, interference with rate limits or Account sanctions, or disruption of another user's enjoyment of WhispR or the proper operation of the Services.
12.5 Other Violations
You must not otherwise violate applicable law, these Terms, or published WhispR policies.
13. Moderation, Reporting, and Enforcement
WhispR may review reports and relevant public content, Account information, and interaction records to investigate suspected violations. We may reduce distribution, restrict features, remove or disable content, preserve evidence, issue warnings, suspend Accounts, or terminate access.
Where required, we will provide notice of enforcement and a reasonable opportunity to dispute a decision. We may act without advance notice where necessary to comply with law, address urgent safety risks, protect users, preserve evidence, or prevent abuse.
We may preserve relevant records and provide information or assistance in response to a valid order or lawful request from a competent court, government authority, or authorised investigative or cybersecurity agency.
We do not guarantee that all objectionable content will be identified or removed. Moderation decisions involve context and may occasionally be incorrect.
14. Intellectual Property and Brand
WhispR, the WhispRai™ name, logos, visual identity, application, software, design, documentation, and non-user content are owned by or licensed to the operator and are protected by applicable intellectual-property law.
No right to use WhispR or WhispRai™ branding is granted except as necessary to use the Services. Feedback may be used without restriction or payment, provided it does not include User Content or Personal Information that we are not otherwise permitted to use.
Copyright or intellectual-property complaints may be sent to support@hellowhispr.com with sufficient information to identify the protected work, challenged content, complainant's authority, location of the content, and requested action. We may request supporting documentation and notify the affected user where appropriate.
We may restrict or terminate Accounts that repeatedly or seriously infringe intellectual-property rights, taking account of available evidence, applicable law, and any legitimate challenge submitted by the affected user.
15. Subscriptions, Payments, and Future AI Features
If paid Subscriptions are introduced, the price, applicable taxes, billing frequency, renewal terms, included features, cancellation process, refund rules, and any app-store conditions will be disclosed before purchase. Mandatory consumer rights remain unaffected.
Unless the purchase screen states otherwise, billing and refunds for purchases made through Apple App Store or Google Play are processed under the applicable store's rules. WhispR will not charge a user for a Subscription without the required explicit purchase confirmation. Any automatic renewal will be clearly disclosed before purchase. You may cancel through the purchase channel, and cancellation ordinarily takes effect at the end of the current paid period unless applicable law or the purchase terms require otherwise.
AI Features such as transcription, summaries, or emotion analysis are planned for eligible paid users. They will be optional and subject to feature-specific disclosures. Eligible audio or transcripts may be sent to a disclosed AI provider, and generated results may be stored with the associated recording.
AI outputs may be inaccurate, incomplete, biased, or inappropriate. They are not medical, mental-health, legal, financial, emergency, or other professional advice. Do not rely on them where errors could cause harm. WhispR does not use Private Recordings to train public AI models without permission.
16. Third-Party Services and Links
WhispR relies on third-party infrastructure and services, including Supabase, Firebase, authentication providers, email-delivery providers, app stores, and, if enabled, a disclosed AI provider.
Third-party services and external links may have separate terms and privacy practices. WhispR is not responsible for an external service outside its reasonable control, but this does not limit responsibility that applicable law places on WhispR for processors it appoints or Services it supplies.
17. App Stores, Devices, and Connectivity
Your use of the mobile application may also be subject to the applicable app store's terms. Those platform terms govern your relationship with the platform provider; these Terms govern your relationship with WhispR.
You are responsible for a compatible device, operating system, internet connection, and any carrier, mobile-data, messaging, or other third-party charges. WhispR does not guarantee compatibility with every device or operating-system version.
18. Notifications and Electronic Communications
WhispR may send Account verification, password recovery, security, deletion, legal, service, and Community-activity communications. You may manage optional notifications through WhispR or device settings. Essential operational, security, legal, and Account communications may still be sent where permitted by law.
You consent to receive records and notices electronically through the email associated with your Account, an in-app notice, push notification, or publication on the website, as appropriate. You are responsible for keeping your email address current. A notice is considered provided when sent or made available, subject to applicable law.
19. Account Deletion
You may request deletion through available Account settings or the support process. After confirmation, the Account enters a 30-day grace period. Access may be restricted during that period, and you may cancel before the scheduled date. Permanent deletion cannot be reversed.
Private Recordings are always deleted during permanent deletion. By default, Public Recordings and public Voice Replies are also deleted. If the deletion flow offers preservation and you expressly select it, eligible public content may remain under "Deleted User" with profile identity removed. Voice may nevertheless identify the speaker.
Preserved content cannot be reclaimed by registering again with the same email. Limited records may remain where required for backups, security, fraud prevention, moderation, legal compliance, or dispute resolution, as described in the Privacy Policy.
20. Suspension and Termination
You may stop using WhispR at any time. We may restrict, suspend, or terminate access if we reasonably believe you violated these Terms, created risk or harm, used the Services unlawfully, failed eligibility requirements, or if action is required by law or platform security.
Where appropriate and legally required, we will provide notice and a reasonable opportunity to appeal. Serious, repeated, urgent, or unlawful conduct may result in immediate action.
Sections intended by their nature to survive termination, including ownership, licences already exercised, retained records, disclaimers, liability provisions, disputes, and final provisions, will survive.
21. Changes to the Services
We may add, modify, suspend, limit, or discontinue features. We will take reasonable steps to notify users of material changes where appropriate.
WhispR does not promise that every feature, Community, recording format, integration, device, or operating-system version will remain supported. This does not limit rights or remedies that cannot legally be limited.
22. Disclaimers
The Services are provided on an "as available" basis. To the maximum extent permitted by law, we do not promise uninterrupted availability, error-free operation, permanent storage, a particular Community response, or that all User Content will be accurate, safe, or suitable.
Users, not WhispR, are responsible for User Content. WhispR is not a medical, mental-health, crisis, legal, or financial service. If you or another person faces immediate danger or an emergency, contact local emergency services or an appropriate qualified professional.
WhispR does not continuously monitor every recording, reply, or Account and cannot guarantee that it will detect or intervene in an emergency.
Nothing in these Terms excludes statutory warranties, consumer rights, or duties that cannot legally be excluded.
23. Limitation of Liability
To the maximum extent permitted by applicable law, WhispR and its operator will not be liable for indirect, incidental, special, consequential, exemplary, or punitive loss, or loss of profits, goodwill, opportunity, data, or business, arising from use of or inability to use the Services.
These Terms do not impose an arbitrary zero-value or fees-paid-only monetary cap on users who have paid no Subscription fee. Subject to applicable law, WhispR remains responsible only for direct losses that were reasonably foreseeable and directly caused by its breach of these Terms.
Nothing excludes or limits liability where it cannot legally be excluded or limited, including liability arising from fraud, wilful misconduct, gross negligence, death or personal injury caused by negligence, or mandatory consumer, privacy, or data-protection rights. A specific aggregate monetary cap may be introduced for paid Services only after review of the pricing, risk profile, and applicable law.
24. Indemnity
To the extent permitted by law, you agree to indemnify and hold harmless WhispR and its operator from third-party claims, losses, and reasonable costs arising from your unlawful User Content, infringement of another person's rights, or material breach of these Terms.
This section does not require a consumer to indemnify WhispR for WhispR's own negligence, unlawful conduct, or breach, and it does not override mandatory law.
25. Governing Law and Disputes
These Terms are governed by the laws of India, without limiting mandatory rights available under applicable consumer or data-protection law.
Before starting formal proceedings, the parties should make a good-faith attempt to resolve a dispute by contacting support@hellowhispr.com and allowing a reasonable opportunity for investigation and response.
If a dispute is not resolved informally, it may be brought before a court of competent jurisdiction in India. These Terms do not require mandatory arbitration and do not restrict either party from seeking urgent interim relief. Nothing in this section limits a user's right to approach a consumer commission, the Data Protection Board of India, a Grievance Appellate Committee, another competent regulator, or any other forum or remedy available under mandatory law.
26. Grievances and Appeals

To submit a grievance, email support@hellowhispr.com and provide the Account or contact information needed for a response, a description of the issue, the relevant recording, reply, profile, or link where applicable, and the remedy requested. Do not include unnecessary passwords, authentication tokens, or sensitive information.
We will acknowledge intermediary-related grievances within 24 hours and resolve general grievances within seven days, or within any shorter period required by applicable law. Certain qualifying content-removal complaints will be handled as expeditiously as possible and within 72 hours. Complaints concerning qualifying intimate content, nudity, sexual acts, or electronic impersonation, including artificially morphed material, will be acted upon within 24 hours where the applicable rule requires it. Reasonable safeguards may be used to prevent misuse of the grievance process.
Where available, users may challenge unresolved intermediary grievances through the applicable Grievance Appellate Committee. An eligible appeal may generally be submitted within 30 days after receiving the Grievance Officer's decision, subject to the applicable rules. Users may also pursue another remedy provided by law.
27. Events Outside Our Reasonable Control
WhispR will not be responsible for delay or failure caused by events outside its reasonable control, including natural disasters, widespread internet or telecommunications failures, cloud-service outages, cyberattacks despite reasonable safeguards, government action, labour disruption, public emergencies, or failures of third-party infrastructure.
This section does not excuse obligations that applicable law does not permit us to avoid. We will take reasonable steps to reduce disruption and restore affected Services where practicable.
28. Changes to These Terms
We may update these Terms to reflect changes in the Services, law, safety practices, providers, Subscriptions, or business operations. Each version will state its effective date and version number.
We will provide notice of material changes through an appropriate channel. Material changes may require renewed acceptance. Changes will not operate retroactively where doing so would unlawfully reduce accrued rights.
29. General Provisions
These Terms, the Privacy Policy, and policies expressly incorporated into them form the agreement between you and WhispR concerning the Services. Feature-specific terms control only for the relevant feature if they expressly state that they override these Terms.
If any provision is invalid or unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions continue in effect. Failure to enforce a provision is not a waiver.
You may not assign these Terms without our consent. WhispR may assign them as part of a legitimate merger, restructuring, financing, acquisition, or transfer of the Services, subject to applicable law and any required notice.
These Terms do not create an employment, partnership, joint venture, fiduciary, or agency relationship between you and WhispR. No person other than you and WhispR has a right to enforce these Terms except where applicable law provides otherwise.
Headings are for convenience. "Including" means "including without limitation." Electronic records and acceptance may be used to evidence this agreement as permitted by law.
